2. Tracking Technologies and Consent
2.1 Tracking Technologies We UseThe Site uses the following tracking technologies, deployed through Google Tag Manager:
Google Analytics 4 (GA4), a web analytics service provided by Google LLC ("Google"). GA4 uses cookies and similar identifiers to collect information about how visitors use the Site, including pages viewed, time spent on the Site, referral sources, and approximate geographic location derived from IP address. We use this information to understand how visitors interact with the Site and to improve the Site over time. For more information about Google Analytics, see https://policies.google.com/privacy. You may opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on, available at https://tools.google.com/dlpage/gaoptout.
Google Tag Manager, a tag management system provided by Google. Google Tag Manager itself does not collect personal information about visitors but is used to deploy the tracking technologies listed above.
We may add additional tracking technologies in the future. If we do, we will update this Privacy Policy to disclose them. Examples of tracking technologies we may add include, without limitation, the LinkedIn Insight Tag, the Meta (Facebook) Pixel, advertising and conversion pixels, customer relationship management (CRM) tracking such as HubSpot, session replay or heat-mapping tools, and similar analytics, advertising, and attribution technologies. Continued use of the Site after we update this Privacy Policy constitutes consent to the updated tracking disclosures.
2.2 Consent to Tracking
By accessing the Site and continuing to use it, you acknowledge and consent to the use of the tracking technologies described in Section 2.1, including the collection, transmission, and processing of the data described in this Privacy Policy. This consent extends to the third-party providers identified above for the purposes described.
You may control or limit certain tracking through:
(a) your browser settings, which typically allow you to refuse new cookies, delete existing cookies, or signal a preference not to be tracked;

Your election to limit optional tracking may affect certain features of the Site but will not prevent you from using the Site.
2.3 Do-Not-Track Signals
Some browsers transmit "Do Not Track" or similar signals. There is currently no industry standard for how websites should respond to such signals, and the Site does not currently respond to Do Not Track signals. We will update this Privacy Policy if a standard is adopted that we elect to follow.
2.4 Substantiation of Data-Handling Claims
If you believe that your personal information has been collected, used, shared, or processed in violation of this Privacy Policy or applicable law, you must, as a condition precedent to bringing any claim arising from such alleged violation, provide us with:
(a) a complete, unedited copy of the data forming the basis of your claim;
(b) a detailed written explanation specifying the nature of the alleged violation, the date or dates on which it occurred, the URLs of the pages on which it occurred, the device and browser used, and the IP address used; and
(c) the legal theory or theories on which the claim is based.
This requirement is intended to enable a meaningful investigation of any alleged violation. It is part of the Initial Dispute Notice requirements set forth in Section 12 of our Terms of Service, which is incorporated by reference into this Privacy Policy.

Business transfers. We may share or transfer information in connection with a merger, acquisition, financing, sale of assets, reorganization, bankruptcy, or similar transaction, in which case the information will be subject to this Privacy Policy unless and until updated.
With your consent. We may share information for any other purpose with your consent.
The CCPA and certain other laws define "sharing" or "sale" of personal information broadly to include certain disclosures to third parties for cross-context behavioral advertising or for the third party's own purposes. Although the Site uses Google Analytics for analytics purposes only, we do not currently engage in any practice that we believe constitutes a "sale" of personal information under the CCPA. The use of Google Analytics may, depending on your settings and Google's configuration, constitute "sharing" for cross-context behavioral advertising under the CCPA. You may opt out of any such sharing using the mechanisms described in Section 2.2 and Section 6.

5. Data Retention
We retain personal information only for as long as is necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements. Form submissions and email communications are retained for as long as we maintain an active business relationship with you and for a reasonable period thereafter for record-keeping, potential follow-up, and legal compliance purposes. Automatically collected analytics data is retained in accordance with the default settings of the underlying tracking technologies, typically 14 months for GA4 unless we elect a different retention period.
6. Your Privacy Rights
Depending on where you live, you may have certain rights regarding your personal information.
6.1 California Residents (CCPA Rights)
If you are a California resident, the CCPA provides you with the following rights with respect to personal information that Amplifyed collects:
(a) Right to know. You have the right to request that we disclose the categories of personal information we have collected about you, the categories of sources of that personal information, the business or commercial purposes for collecting it, the categories of third parties with whom we have shared or disclosed it, and the specific pieces of personal information we have collected about you.
(b) Right to delete. You have the right to request that we delete personal information we have collected from you, subject to certain exceptions provided by law.
(c) Right to correct. You have the right to request that we correct inaccurate personal information we maintain about you.
(d) Right to opt out of sale or sharing. You have the right to direct us not to sell or share your personal information. As described in Section 4, we do not sell personal information for monetary consideration. To opt out of any sharing of personal information for cross-context behavioral advertising under the CCPA, please send a request to legal@amplifyed.io with the subject line "Do Not Share My Personal Information."
(e) Right to limit use of sensitive personal information. As described in Section 1.3, we do not knowingly collect sensitive personal information.

Without limiting the foregoing, the procedural requirements set forth in Section 12 of the Terms of Service, including the Initial Dispute Notice requirements, the disclosure requirements, the informal resolution and meeting requirements, the binding arbitration agreement, and the class action waiver, apply to any such dispute.

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this Privacy Policy.
